O Supremo Tribunal Federal (STF) definiu nesta quinta-feira (09) que os munic\u00edpios n\u00e3o podem contrariar a lei federal que regulamentou os servi\u00e7os de motoristas particulares dos aplicativos Uber, Cabify e 99. A Corte tamb\u00e9m estabeleceu que qualquer proibi\u00e7\u00e3o ou restri\u00e7\u00e3o aos aplicativos \u00e9 inconstitucional.<\/p>\n
As decis\u00f5es foram tomadas a partir do encerramento do julgamento sobre a legalidade dos servi\u00e7os de aplicativos. Na quarta-feira (8), por unanimidade, o STF decidiu que os munic\u00edpios podem fiscalizar o servi\u00e7o, mas n\u00e3o podem proibir a circula\u00e7\u00e3o dos motoristas.<\/p>\n
O Supremo julgou a\u00e7\u00f5es contra leis de Fortaleza e de S\u00e3o Paulo proibindo a atua\u00e7\u00e3o dos motoristas. O caso foi julgado a partir de a\u00e7\u00f5es protocoladas pelo PSL e pela Confedera\u00e7\u00e3o Nacional de Servi\u00e7os (CNS).<\/p>\n
“No exerc\u00edcio de sua compet\u00eancia para regulamenta\u00e7\u00e3o e fiscaliza\u00e7\u00e3o do transporte privado individual de passageiros, os munic\u00edpios e o Distrito Federal n\u00e3o podem contrariar os par\u00e2metros fixados pelo legislador federal e Constitui\u00e7\u00e3o Federal”, decidiu o STF.<\/p>\n
Em mar\u00e7o de 2018, a Lei n\u00ba 13.640 regulamentou a atividade e definiu que o motorista desses aplicativos deve possuir uma vers\u00e3o da Carteira Nacional de Habilita\u00e7\u00e3o na categoria B ou superior, que informe que exerce atividade remunerada.<\/p>\n
Outros pr\u00e9-requisitos para obter a permiss\u00e3o s\u00e3o manter em dia o Certificado de Registro e Licenciamento de Ve\u00edculo e apresentar certid\u00e3o negativa de antecedentes criminais.
